Lynsey Mincher

Experienced Family Lawyer

Born in Yorkshire, England, Lynsey graduated from the College of Law, York. She initially practiced Criminal Law both as a Defence Lawyer and as a Senior Crown Prosecutor. As a Criminal Lawyer, Lynsey appeared in court on a daily basis prosecuting and defending people charged with various offences. She received training in Domestic Violence, drug and alcohol abuse, and the impact this can have on families and people required to testify. Lynsey also worked in the Magistrates Court advising the Magistrates and the District Judges on law and procedure and was the main advisor to the Magistrates on Youth Criminal matters.

After moving to Canada in 2005, Lynsey worked in the area of Family Law as Director’s Counsel for the Alberta Government, predominantly in the area of Child Protection and enforcement of Support as Counsel for the Director of Maintenance Enforcement. She expanded on her extensive trial experience, representing the Director in all levels of Court.

Lynsey is experienced in the areas of Divorce, Separation, Custody, Spousal Support, Child Support, International Custody Issues and Child Protection matters.

Lynsey has over 15 years of extensive trial and appellate experience, appearing before the Provincial Court, Court of Queen’s Bench and Court of Appeal. She has been practicing exclusively in the area of Family Law since 2007 and has a particular interest in custody disputes including mobility, Hague applications (international child abduction), child protection involving parents, foster parents and extended family and Emergency Protection Orders. She has provided opinions to the High Court in England on Child Protection matters with an international perspective. She is a skilled litigator, and is also trained as a Mediator and Parenting Coordinator, calling on her extensive trial, cross- examination experience and mediation and negotiation skills to assist her clients. Lynsey also represents children who are involved in the Child Protection system, ensuring their voices are heard.

Lynsey recognizes that generally family issues are usually better resolved outside a courtroom and litigation is often the last resort both in terms of the financial and emotional cost to the client. Her experience representing children provides her with a unique perspective of the impact family litigation can have on even the most vulnerable of individuals. Lynsey works with her clients to attempt to resolve their issues in a family focused manner, even when domestic violence or addiction issues are present, but understands that this is not always possible. Lynsey ensures her clients can make an educated and fully informed decision about each step taken in their matter, with a full understanding of all the legal and practical aspects, allowing them to maintain full control over their matter.

Lynsey is licensed to practice law in both Alberta and England and Wales.

Lynsey teaches the Parenting after Separation and Parenting after Separation High Conflict courses. She volunteers her time as a presenter, instructor and evaluator of the Bar Admission Course for the Legal Education Society of Alberta. She has volunteered at Women’s Shelters providing free legal advice to families unable to access other legal services.  She has provided free legal advice to families facing serious urgent legal issues.
